Press Now: journalist movement successful

From PressNow.org, January 13th 2010

Iraqi journalists from the Awene escape prosceution - journalist movement successful
Under international and national pressure, the Kurdistan Democratic Party (KDP) –  the party of President Massuad Barzani, of the Kurdish autonomous region in Iraq – dropped the lawsuit against opinion writers Aras Fatah and Mariwan Kanie. "The KDP is far too great to be dealing with such minor controversies," said Barzani's press secretary. Aras Fatah and Mariwan Kanie responded sceptically. In a statement they called the excuse "of a low level" and "extremely unprofessional" nature.

Successful counter-action from local journalists
The charges against Fatah and Kanie led to a movement of local journalists, intellectuals and human rights organizations in favour of Fatah and Kanie. Awene published the challenged article again, now signed by over 150 activists. International organizations expressed concern as well. The action has been successful: the charges against Fatah and Kawie have been dropped. The campaign, however, continues.

Awene published the challenged article again, now signed by over 150 activists. International organizations expressed concern as well. The action has been successful: the charges against Fatah and Kawie have been dropped. The campaign, however, continues. The same institutions that supported the movement for the two authors are launching a campaign focused on withdrawing all open cases against journalists. "We request that the KDP and president of the region withdraw all their lawsuits and end these abnormal and non-democratic system," write Aras Fatah and Mariwan Kanie on sbeiy.com in their statement.

35 cases against Awene
Awene, one of the three independent newspapers in Iraqi Kurdistan, has been a reliable partner of Press Now since 2006. Awene's chief editor, Shwan Mohammed, had to pay a bail of $ 1300 to avoid being jailed for the opinion piece. There are currently 35 cases against Awene. If all require penalties to be paid, Awene will have no choice but to close down. The fact that KDP judged approved earlier fines means the outlook is bleak.  Asos Hardi, the owner of the Awene holding, has asked international NGO's to keep the pressure on the Kurdish authorities to not limit the freedom of speech in Kurdistan: "What KPD does not want is to loose the sympathy of Europe."

Kurdish Press Freedom
Iraqi Kurdistan is still considered one of the regions with the most press freedom in the Middle East. The situation threatens to deteriorate rapidly, however. Shortly after Barzani's speech the KDP began lawsuits against Kurdish independent media. Kurdistan passed a new press law in 2008. This law prohibits prosecution based on an opinion piece. The law was signed by the same Barzani who now threatens the independent media with fine after fine. In order to continue imposing restrictions on independent media he is relying on the use of obsolete laws from the days of Saddam Hussein.

The KDP has withdrawn it's lawsuit against Aras Fatah and Mariwan Kanie.

Campaign launched to support withdrawal of outstanding lawsuits against free media

By KurdishMedia.com

The Kurdistan Democratic Party, led by Massuad Barzani, has withdrawn its lawsuit against both writers Aras Fatah and Mariwan Kanie, according to Khabat newspaper on Friday, the 7th January 2011. "The KDP is much greater than that occupying itself with these insignificant polemics," Barzani's press secretary stated in the KDP's organ Khabat (aka: Xebat) on Friday.

It was declared by Faysal Dabagh, Massuad Barzani's press adviser, on Friday that only yesterday, i.e. Thursday, Barzani was made aware of the lawsuit. The statement by Dabagh did not explain whether Barzani had been made aware of the other lawsuits which are still outstanding against free media and writers and whether the KDP regard these as "insignificant polemics" too – as claimed.

In a statement which has been posted in Kurdish by Sbeiy.com, both writers replied Barzani's press secretary's statement. Aras Fatah and Mariwan Kanie have declared in their statement: the explanation and excuse, which is given by Dabagh, is at a very low level and extremely unprofessional. Instead of admitting that the KDP made a mistake and that the president of the KRG wishes to rectify it; his press secretary states in a patronising manner that the KDP is much greater than occupying itself with these insignificant polemics.

We request from the KDP and president of the region to withdrew all their lawsuits and end this abnormal and non-democratic circumstances which has been created, the writers Aras Fatah and Mariwan Kanie elaborated in their sbeiy.com statement.

The withdrawal of the KDP lawsuit against the two writers triggered launching a campaign to withdraw all the outstanding lawsuits. To sign the campaign, please send your support to this email, which is posted by Hawlati website on Friday:

Support Free Speech in Kurdistan

Kurdishaspect.com – By Asos Hardi

Dear Sir/ Madam

As you may know, during the past year Kurdistan Democrat Party (KDP) has filed  many lawsuits against free press and independent writers who wrote criticizing articles about KDP's leader Masud Barzani (president of the Region) and his family members who occupy high positions in Kurdistan Regional Government.

These cases are bypassing the press law adopted by Kurdistan Parliament and signed by Barzani himself. Another important point is: the majority of these lawsuits are made against opinion articles and not news articles.
The last one was against two well known Kurdish writers who live in Europe, Aras Fatah and Mariwan Kanie. They wrote an article in Awene (June 8th, 2010) under the headline: "What Did the Kurdistan Regional President Say?".

As a response to these lawsuits a group of media outlets and civil society organizations republished the article in Kurdish, Arabic and English and more than 200 writers, intellectuals and activists signed the article to be "Theirs" and distributed with Awene newspaper yesterday (January 4th, 2010).  The main goal of this mutual publication is not only to support these two writers (as mentioned in the publication), but to express solidarity with all writers who have been under pressure during 2010.

Dear friends,

In this hard time of freedom of speech in Kurdistan, we need your help and support.

Please support freedom of speech in any way you can.

Kind regards
Asos Hardi
General Director
Awene for Press and Publishing
